An adviser to the European Court of Justice, Advocate General Maciej Szpunar, said Google’s Gemini chatbot could breach EU press publishers’ rights when it takes material from news articles and uses it in answers to users, though training AI models on protected articles is allowed under the text and data mining exception. The opinion arises from a suit by Hungarian publisher Like Company against Google Ireland over Gemini’s summaries of its articles; the case, C-250/25, is the EU court’s first on generative AI and copyright. The court is not bound by the adviser’s view but usually follows it, with a final ruling expected in about six months.
